1 NOTES TO ASSIST COMPLAINANTS TO COMPLETE THIS FORM
The Information Commissioner has power to review decisions made by agencies in respect of access applications and applications for amendment of personal information.
PERSONAL DETAILS
It is important that you give your full name and all contact details. The address you give must be an address in Australia.
You must attach a copy of the Notice of Decision supplied by the agency. It should be the Notice of the Internal Review decision. If you do not have an extra copy, enclose the original and the Information Commissioner will copy it and return the original to you. Provide brief details only on this form.
Applications to the Information Commissioner must be lodged within the following time limits:
· Within 60 days of notice of the agencys decision. (if you are the applicant for access or amendment)
· Within 30 days of notice of the agencys decision. (if you are a third party)
THIRD PARTY
A third party is a person who objects to an agencys decision to give access to personal information or business information about that person to someone else.
Except where a decision is made by the principal officer of the agency, review by the Information Commissioner is not normally available until you have applied to the agency for internal review of the decision.
The Information Commissioner may decide not to deal with a complaint if it is not within the Information Commissioners jurisdiction or if it is frivolous, vexatious, misconceived or lacking in substance. You will be given reasons for this decision if the Information Commissioner decides not to deal with the matter.
The Information Commissioner may allow an extension of the time limits. If you require an extension of time, you must explain why.
